“Star World Pick Your Show (Poll)” RULES AND REGULATIONS
The following are the rules and regulations for “Star World Love2HateU Twitter Contest” (“Contest”) hosted on www.twitter.com (“Twitter”), the Star World India Twitter Page (http://www.twitter.com/StarWorldIndia) and Star World Channel (“Channel”).
By entering the Contest the viewer unconditionally accepts and agrees to comply with and abide by the terms and conditions herein (“Terms”). The decisions of Star India Private Limited (“STAR INDIA”) for all matters relating to the Contest shall be final and binding in all respects.
PART A- PRINCIPAL TERMS
1. The Contest shall commence from 1st January 2012 at 21:00 hours up to 1st January 2012 at 22:00 hours (“Tweeting Period”) on Twitter and on the Channel.
2. The Channel shall announce the Contest via tweets on the Star World India Twitter page.
3. To participate in the Contest the viewer(s) needs to have a Twitter account at the URL www.twitter.com, login with their Twitter account details (“Handle”), and submit their messages (“Tweets”) with the suffix #Love2HateU (“Hashtag”).
4. 25 of the most interesring live tweets done during the show on 1st December between 9pm and 10 pm to win a Star World India Calendar (“Prize”) courtesy of Channel worth INR 1000/-.
5. The tweets to be selected basis the following criteria:-
• The tweet must have Abhishek Bachchan mentioned in the tweet or something related to Abhishek Bachchan
• The tweet must be interesting and must pass atleast 3 of the following parameters:-
• Funny
• Relevant to the episode
o Describes, as precisely as possible, the context within the episode
o Is not an arbitrary statement not connected at all with the episode
• Uses the concerned hashtag
• It must be original and witty
6. The Tweets must not be in any way:-
• Should NOT in any way be derogatory, defamatory, vulgar, ridicule the celebrity, inflict injury on reputation, blasphemous, put the celebrity in a false light, attack the morality of the celebrity etc. We need to keep in mind that any person, who intentionally and maliciously publishes or distributes such statement, is also liable as if he had made such statement himself
• Should not make a reference to the celebrity’s personal life/ family/sexual orientation etc.
• Should not be referring to matters under litigation, i.e. I don’t like Salman- the blackbuck killer, etc. or Salman has ‘accidently’ run to the popularity charts’ or something like that.
• Should not be based on any unconfirmed rumors
7. The viewer(s) details will be recognized with the Handle.
8. Tweets sent after the Tweeting Period will not be considered for the Contest and shall be deemed null and void.
9. STAR INDIA and/or Channel shall not be responsible or liable for any technical disruption and/or failure/ and/ or any other difficulties of such nature, due to which the viewers(s) is unable to participate in the Poll.
10. On January 5, 2012 on or between 11:00 hours to 18:00 hours the Channel will announce the names of Winners via a tweet on the on Star World India’s Twitter page (http://www.twitter.com/StarWorldIndia). Post announcing the winner they will be contacted within 48 hours to reply with their contact address details to dispatch the prize. If they do not reply in 48 hours the prize will be automatically given to the next winner.
11. STAR INDIA and/ or Channel shall not be subject to any appeal of any nature whatsoever. Participation in the Contest shall be construed that the viewer(s) has waived his/her right to dispute any decision(s) made by STAR INDIA.
12. Limitations of liability: by entering the Contests, each Viewer acknowledges and agrees that: (i) any and all disputes, claims and causes of action arising out of or in connection with the Contest, shall be resolved individually, without resort to any form of class action; and (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred and associated with entering the contest (if any).Notwithstanding the foregoing, under no circumstances will STAR INDIA be liable for any consequential, indirect, special punitive, or incidental damages or lost profits, whether direct or indirect, arising in any way whether in contract, tort (including negligence) or otherwise.
PART B- GENERAL RULES
1. STAR INDIA and/ or Channel reserves all rights to make amendments to the existing rules without prior notice. It shall be the sole responsibility of the viewer(s) to check the rules and regulations of the Contests on the official STAR World page.
2. Non-conformance by the viewer(s) to any and all the rules will make such viewers entry(ies) null and void.
3. The viewer of the Contest agrees that he/she shall hold harmless the Channel, STAR INDIA, its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him/her, in any manner, whatsoever in connection with the Contest and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the sponsor and/or the Channel and/or STAR INDIA to claim any damages or reliefs.
4. STAR INDIA and/ or Channel is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the voter in any manner whatsoever, in connection to the Contest.
5. Employees of the Channel, STAR INDIA, and the members of their immediate family, persons with criminal convictions, persons other than citizens of India, are ineligible to vote and be part of the Contest.
6. The viewers(s) shall hold harmless the sponsor, the Channel, STAR INDIA, its affiliates, its group companies, their employees, officers, directors or any other person from and against any injury/damage/harm/loss/ death/ mental or emotional trauma suffered by the viewers(s), in any manner whatsoever in connection with the Poll and waives all rights to file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India to claim any damages or reliefs.
7. The participation of the viewer(s) in the Contest shall mean that the viewer (s) has read, understood, accepted and agrees to abide with all the rules including the general rules of the Contest.
8. The outcome of the Contest/the decision made by STAR INDIA and/ or Channel regarding the Contest shall be final and binding on the viewers and in no event shall the viewer/voter dispute the decision made by STAR INDIA, Channels and/or its employees in connection to the Contest.
9. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Contest shall be referred to a sole arbitrator appointed by STAR INDIA and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language.
